eBRAM International Online Dispute Resolution Centre (“eBRAM”) is a not-for-profit company limited by guarantee established in 2018, with the support of Asian Academy of International Law Ltd, Hong Kong Bar Association, and The Law Society of Hong Kong. eBRAM tasks itself to elevate Hong Kong’s arbitration and mediation services and build capacity to meet the rapidly expanding demand for online dispute resolution and deal-making services across the borders by utilising innovative technologies to enable the city to become a LawTech centre and hub for international business dispute avoidance and resolution and collaborate with global organisations and participating economies such as the Asia-Pacific Economic Cooperation (APEC), the Association of Southeast Asian Nations (ASEAN), Belt-and-Road countries and beyond.

eBRAM has developed its ODR platform and DMP Portal leveraging the latest technologies, including artificial intelligence, blockchain and cloud. Cybersecurity and data privacy are our top
priorities, and eBRAM makes every effort to ensure the security of information proceeded and stored on its platform.

eBRAM Secretariat aims to ensure a user-friendly balance between technology and human touch and assist the users at every step of the electronic process. Substantial cost savings can be achieved compared with traditional dispute resolution by allowing parties to choose how they wish to use the electronic platform and services. Electronic payment is also enabled. Experienced mediators and arbitrators are drawn from a premier pool of international experts.

Essential conventional meetings and hearings can be arranged through the electronic platform and video-conferencing is available during the process to maximise efficiency and reduce costs.

With its two main features Deal Making and Online Dispute Resolution, eBRAM is developing an online dispute resolution (ODR) platform to provide a one-stop-shop platform for commercial parties from all around the world.

Deal Making

Through eBRAM online deal-making platform, parties from different locations can efficiently negotiate a deal by conducting meetings, sharing documents such as offers, contract drafts, to conclude their agreement digitally.

Online Dispute Resolution

In a case of dispute, parties can commence Online Dispute Resolution (ODR) proceedings through the eBRAM platform. ODR is a branch of dispute resolution which uses technology to facilitate the resolution of disputes between parties. Parties can opt for an online negotiation, e-mediation or e-arbitration, or a combination of all three. ODR is the online equivalent of alternative dispute resolution.

e-Mediation

Parties to a dispute may commence an e-mediation, with meetings being conducted virtually through the platform where the mediator can communicate separately with each party or simultaneously with both parties.

e-Arbitration

e-Arbitration can be defined as arbitration in which all aspects of the proceedings are conducted online. Most e-arbitrations require parties to upload the submissions and evidential documents to the tribunal and to respond to questions from the arbitrator. On the contrary, hearings of e-Arbitrations administered by eBRAM are also conducted through video conferencing in a secure environment. Participating parties will receive a final, binding, and enforceable award from the arbitrator in the end via the eBRAM platform.
